Terms of Service

1. Acceptance of Terms

By downloading, installing, or using the wisp macOS application ("wisp" or the "App"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use wisp.

2. Description of Service

wisp is a virtual pet desktop app for macOS that may provide features such as:

• An interactive desktop companion that lives on your Mac
• Care reminders and attention prompts
• Pet photos and other local companion interactions
• Optional premium features unlocked with a paid license
• Optional in-app update checks and downloads

3. License Grant

Free Version

We grant you a limited, non-exclusive, non-transferable, revocable license to use wisp's free features for personal, non-commercial use.

Premium License

A premium license grants access to paid features. Unless otherwise stated at the time of purchase, premium licenses are:

• Per-user: Intended for your own use and subject to device activation limits
• Non-transferable: Not for resale, redistribution, or shared use outside your permitted use
• Perpetual for the current offering: Wisp's current premium offering is a one-time purchase with no subscription, unless a different purchase model is clearly disclosed in the future

4. Acceptable Use

You agree NOT to:

• Reverse engineer, decompile, or modify the App except where prohibited by applicable law
• Circumvent license validation or copy protection
• Use wisp for any illegal or unauthorized purpose
• Distribute, sell, lease, or sublicense the App
• Remove or alter any proprietary notices

5. App Features and Your Responsibility

Some features of wisp affect files or content on your Mac only when you choose to use them.

• Pet Photos: If you save a pet photo, you are responsible for choosing where to save it and for managing that exported file
• Dock Drop Snacks: If you enable the dock-drop feature and drag files onto Wisp, those files may be moved to Trash as part of the feature
• Launch at Login and Updates: If you enable those features, wisp may register itself to open at sign-in and may check for or download app updates in the background

6. Intellectual Property

wisp, including its code, artwork, design, animations, and user interface, is owned by Gleemy Labs LLC or used under appropriate license. All rights reserved. You may not copy or reproduce any part of wisp except as allowed by law or with our written permission.

7. Payments and Refunds

• Payments: Processed securely through Stripe
• Pricing: Subject to change for future purchases. Existing paid licenses remain subject to the terms in effect when purchased unless otherwise required by law
• Refunds: You may request a refund within 3 days of purchase. No reason is required.

8. Disclaimer of Warranties

wisp is provided "AS IS" without warranties of any kind. We do not guarantee:

• Uninterrupted or error-free operation
• Compatibility with all macOS versions, devices, or third-party software
• That the App will meet your specific needs or expectations

9. Limitation of Liability

To the maximum extent permitted by law, Gleemy Labs LLC shall not be liable for:

• Any indirect, incidental, or consequential damages
• Loss of data, profits, or business opportunities
• Damages exceeding the amount you paid for wisp (if any)

10. Termination

We may terminate or suspend your access to wisp if you violate these Terms. Upon termination:

• Your license is revoked
• You must stop using the App
• Local data may remain on your device until you remove it

11. Changes to Terms

We may update these Terms periodically. Continued use of wisp after changes constitutes acceptance of the new Terms.

12. Governing Law

These Terms are governed by the laws of the State of New Mexico, USA, without regard to conflict of law principles.
